Terms for using Booked 305

Effective September 20, 2026. Booked 305 is a brand of Data Driven Solutions Inc, Miami, Florida.

These terms apply to booked305.com and to the Booked 305 online booking service ("the Service"). There are two kinds of users: businesses that subscribe to Booked 305 to take appointments on their own website, and customers who book appointments with those businesses. By using the Service you agree to these terms and to our Privacy Policy.

1. What Booked 305 does

Booked 305 designs websites for local businesses and provides software that lets their customers book appointments online, receive confirmations and reminders by email or text, join a waitlist, and pay deposits or balances. Booked 305 provides the tools; each business provides the actual services (for example a lash appointment or a dental cleaning) and is responsible for them.

2. For customers who book an appointment

• Your appointment is with the business, not with Booked 305. Prices, durations, deposit rules, cancellation windows and no-show fees are set by the business and shown before you confirm.
• Deposits are charged by the business through Stripe and applied to your service. Whether a deposit is refundable depends on the business's cancellation policy shown at booking, usually free cancellation up to 24 hours before.
• Questions, complaints or refunds about a service go to the business. We will help route you to them and can assist with technical issues.
• Provide accurate contact details so confirmations and reminders reach you. Reminders are a courtesy; you remain responsible for attending or cancelling on time.
• Text messages are optional and governed by the SMS program terms in our Privacy Policy. Reply STOP to opt out at any time.
• Do not book on behalf of others without their permission, make repeated bookings you do not intend to keep, or interfere with the Service.

3. For businesses subscribing to Booked 305

Plans and payment

• Plans are described at booked305.com/#pricing: a one-time setup fee and a monthly membership, billed in advance through Stripe. Prices exclude payment processing fees and text message costs, which are passed through at cost.
• The membership renews monthly until cancelled. You can cancel from the dashboard at any time; the Service stays active until the end of the paid month. Setup fees and partial months are not refunded.
• If a payment fails, we will retry and notify you; after 14 days without payment the booking features may be paused until the balance is settled.

Your customers and your data

• You own your customer and appointment data. We process it on your behalf to run the Service, as described in the Privacy Policy, and you can export it at any time.
• You are responsible for the accuracy of your services, prices, hours and policies, for honoring bookings made through the Service, and for complying with laws that apply to your business, including consumer protection and licensing.
• You agree to use text messaging only for appointment-related notifications sent through the Service, and not to import numbers without consent.

Payments through Stripe

• To take deposits or payments you connect your own Stripe account. Funds go directly to you; Booked 305 does not hold your money. Stripe's Connected Account Agreement applies.
• Refunds, chargebacks and disputes with your customers are handled by you in your Stripe account. We provide the booking records to help.

Your website

• Websites we build for you are yours once the setup fee is paid, including the domain you register. Hosting and the booking software are provided while your membership is active. If you cancel, we will hand over the site files on request.
• You give us permission to show your site in our portfolio unless you tell us not to.

5. Acceptable use

Do not use the Service for anything unlawful, to send spam or unsolicited messages, to attempt to access other users' data, or to overload or reverse engineer the Service. We may suspend accounts that put other users, businesses or the Service at risk.

6. Availability and changes

We aim for the Service to be available at all times but cannot guarantee it. Maintenance and outages of providers such as Cloudflare, Stripe or Twilio can interrupt bookings or messages. We may improve or change features; if a change materially reduces what your plan includes, we will tell you at least 30 days in advance.

7. Limitation of liability

To the extent permitted by law, Booked 305 is not liable for missed appointments, no-shows, lost revenue, or indirect or consequential damages arising from the use of the Service, including undelivered messages. Our total liability to a business for any claim is limited to the membership fees paid in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law.

8. Governing law

These terms are governed by the laws of the State of Florida, and disputes are resolved in the state or federal courts located in Miami-Dade County, Florida.

9. Changes to these terms

We may update these terms and will post the new version here with a new effective date. Continued use after the change means you accept it. Businesses are notified of material changes by email.
